📋 Terms and Conditions

§ 1 Scope

These Terms and Conditions apply to the use of the TookAndCook app and all related services.

§ 2 Contract Formation

• The usage contract is concluded upon registration of a user account or – when using without registration – upon first launch of the app.
• You must be at least 16 years old. Use by persons under 16 is not permitted.
• By using the app, you accept these Terms and the Privacy Policy.

§ 3 Scope of Services

FREE (without account)

• Local storage of recipes (limited quantity)
• Limited number of AI functions
• Meal planner and shopping list

PREMIUM / FAMILY (with subscription)

• Extended storage capacity
• Extended AI quotas
• Cloud synchronization across all devices
• Family Sharing (FAMILY only)

Exact limits are displayed in the app. Changes are only made for objective reasons and in consideration of user interests.

§ 4 Prices and Payment

• Prices are displayed in the App Store / Play Store (incl. VAT)
• Subscriptions renew automatically unless cancelled
• Cancellation must be made before the end of the current billing period to avoid renewal
• Cancellation is done through the respective app store

§ 5 Right of Withdrawal

All purchases are processed through the Apple App Store or Google Play Store. Payment processing, withdrawal, and refunds are handled by the respective app store. The withdrawal and refund policies of the respective store apply additionally. For refund requests, please contact the respective store directly.

§ 6 Usage Rules

You may: Use the app for private purposes, save and share recipes.

You may not: Upload illegal or inappropriate content, manipulate the app, or commercially resell it.

You are responsible for the content you upload (images, texts, URLs) and ensure that no third-party rights are violated.

§ 7 AI-Generated Content

• Allergens: AI recipes may not consider all allergens. Check all ingredients yourself!
• Quantities: Verify quantities before use, especially for spices.
• Personal responsibility: Use is at your own risk.
• No advice: The content provided does not constitute legal, medical, or nutritional advice.

§ 8 Liability

• We are fully liable for intent, gross negligence, and personal injury.
• For slight negligence, we are only liable for breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to foreseeable, contract-typical damages.
• For AI-generated content, we are not liable for slight negligence unless essential contractual obligations are breached (see § 7).
• The above limitations of liability also apply in favor of our vicarious agents.

§ 9 Termination

• Subscription cancellation: Through the App Store / Play Store. Cancellation must be made before the end of the current billing period.
• Account deletion: In the app under Settings → Account → "Delete Account"
• We may block access in case of violations of these Terms (see § 11).

§ 10 Copyright and Usage Rights

• Recipes and content you create remain your property.
• You may freely use AI-generated content for private purposes.
• Commercial use of app content without our prior consent is not permitted.
• You grant us the right to store, process, and share your content as part of providing the service and the features you use (e.g., sharing).
• The app, its design, and its features are protected by copyright.

§ 11 Account Suspension

We reserve the right to temporarily or permanently suspend access in case of serious or repeated violations of these Terms. You will be notified in advance by email, unless immediate action is required for important reasons (e.g., acute abuse, illegal content).

In case of suspension, existing payment obligations remain unaffected.

§ 12 Final Provisions

• Applicable law: German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
• Jurisdiction: For disputes with businesses, Ingolstadt is the exclusive place of jurisdiction. For consumers, statutory provisions apply.
• Changes: We may change these Terms with reasonable notice. You will be informed of significant changes by email or in-app notification. If you do not object within 30 days, the new Terms are deemed accepted.
• Severability clause: Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
